When you use Hip Traveller, we store your personal information (Name, Email, and Phone Number) to allow you to sign into Hip Traveller’s application.

No information that you provide Hip Traveller is shared with third parties and your privacy is protected.
Hip Traveller does not use advertisements on its platform.

Hip Traveller does NOT provide any third party with data or on sell information to advertisers.
​
We do not use third party Ads in the Hip Traveller application.
​
Only your name and profile image that you upload on Hip Traveller is shared with people (users) on the application.

When using Hip Traveller your information is used for the following:

Images you upload​

Images are used to provide information about communities, travel, dining and events and are for information purposes only. Images that you share within your private or public groups are for information purposes only.

Hip Traveller stores your images for the purpose of being able to share them with your communities, friends and family.

By accepting our terms and conditions you give consent for Hip Traveller to process your information and images for these specific purposes.

Where we rely on your consent to process images you upload, you have the right to withdraw your consent at any time by deleting your profile from Hip Traveller's app.
-
Any images you delete from Hip Traveller's app are permanently deleted.
-
Hip Traveller does not store deleted images therefore Hip Traveller cannot restore any images you delete.

How to Block and Report Images (content)​

Any images that you find breach our Terms or are offensive to you in any way may be blocked and reported.

Simply click the 'x' button on the bottom left corner of images you view to block and report them to Hip Traveller.

To appropriately report images to Hip Traveller you can send an email via the app once you click 'Report' for breaching copyright, being inappropriate or breaching our policy. When you click the 'Report' button, you can add any information to the email that you think is necessary.

Hip Traveller will take all necessary steps to remove any images reported that Hip Traveller finds has breaches our Terms.

Hip Traveller takes offensive images (content) that breaches our Terms of Use (see below) seriously and will investigate your report.

If Hip Traveller finds that images reported severely breaches our Terms of Use (see below), Hip Traveller will take the necessary steps required and block people (users) from using the Hip Traveller application in the future.

Messaging in Groups (Collections)

All messages are private between you and other people (users) in Groups (Collections) that you create, are invited to or join.

All messages you send and receive are private and can only be seen by people (users) within the Group you chat with. Groups (Collection) in Travel, Dining, and Events are private, so people (users) cannot 'join group' in Travel, Dining and Events.

Only the people (users) within the Groups you create, join or are invited to, can see your messages.
-
People who are not invited to a private Group (Collection) in Travel, Dining, or Events can not see any messages that are part of that Group.

People can not join groups that are private in Travel, Dining or Events. However you can 'exit group' or 'leave group' by clicking the 'exit group' or 'leave group' button.

You can edit or delete your messages in a Group (Community, Travel, Dinner, Explore) at any time.

Hip Traveller does not store deleted messages and therefore cannot restore any messages you delete. They are permanently deleted.

How to Block & Report People (Users) when messaging in Groups (Collections)

All messages are private between you and other people (users) in all Groups (Collections) including Community, Travel, Dining and Events.

To Block and Report a person (user) you think has breached our Terms, simply swipe left and click the 'x' button (block & report) on a person profile (user) icon.

Once you Block a person (user) you will no longer be able to see any messages from them in any Group. Even if a new Group (Collection) is created you will not be able to see this person (user) and this person (user) will not be able to see you or your messages.

If you think a person (user) has breached our Terms or acted inappropriately can report this person (user).

To appropriately report a person (user) you must send an email to Hip Traveller when you click the 'Report' button. You can add any information to the email that you think is necessary.

Hip Traveller takes offensive messages and any breaches of our Terms seriously and will investigate your report before taking further action.

If Hip Traveller finds that this person (user) you have reported severely breaches our Terms of Use (see below), Hip Traveller will remove this person (users) from our service permanently and take the necessary actions Hip Traveller needs according to our Terms of Use (see below).

How to Block and Report Groups (content)​

Any Groups (Collections) in Community, Travel, Dining or Events that you find breach our Terms or are offensive to you in any way may be blocked and reported.

Simply click the 'x' button on the bottom right corner of the Group Profile (Collection Profile) image to block and report the Group to Hip Traveller.

To appropriately report Groups (Collections) to Hip Traveller you can send an email via the app once you click 'Report' for breaching copyright, being inappropriate or breaching our policy. When you click the 'Report' button, you can add any information to the email that you think is necessary.

Hip Traveller takes offensive content and any breaches of our Terms seriously and will investigate your report before taking further action.

If Hip Traveller finds that this Group (Collection) you have reported severely breaches our Terms, Hip Traveller will remove the person (users) who created this Group (Collection) from our service permanently and take the necessary steps Hip Traveller needs to according to our Terms of Use (see below).

How to control & manage your data

If you would like your personal information including email, name, number and profile image removed from Hip Traveller then simply delete your profile.

You can find the 'delete' button on the top left corner of your profile information screen which is viewed when clicking the pencil 'edit' icon. After clicking delete you will be asked to enter your password before all your information is deleted.

Once you delete your profile from the Hip Traveller app all your personal information including any messages or images that you uploaded will de deleted permanently.

Once you delete your profile, Hip Traveller cannot restore any data. It is deleted forever and cannot be recovered.

You have the option of sharing images you upload, Group names, and Group details that you create in Groups (Collections) with your contacts.
-
You may also share Group (Collection) information with the wider Hip Traveller community by creating a 'Community' Group.
-
You may delete a Group you create at anytime. Once it is deleted all the information shared in the Group is permanently deleted and cannot be recovered.
-
If you would like to delete any information in Collection (Group) you create for 'Community' and the wider Hip Traveller community then you can simply 'delete' this Group you created.

Any information you create in a Group can be edited at anytime you choose.

What data is collected and how is it used
When you use Hip Traveller we process the following information:

Your name, email, phone number and any profile image you choose to upload.

Group titles, dates, price information, what to expect ‘details’, and any links you enter into group information.

The location of places or events that you enter into groups.
-
All messages are private and only shared with contacts you choose to share them with therefore we do not share your private chats with any third parties.

Hip Traveller only stores the information you share so that you can use the application and share it with your contacts or the wider Hip Traveller community.
If you delete any content (data) whilst using Hip Traveller (Groups, Images, Messages or your Profile) then the information is deleted forever and Hip Traveller can not recover it because it is no longer stored.
​
How to control your Group information
You can edit or delete any ‘Collection’ which is a type of Group (Community, Travel, Dining, Events).

Once you delete a Group all the information associated with that Group including titles, dates, price information, location, 'what to expect' and any images will be deleted. All messages shared with your contacts in that Group will also be deleted.

Once you delete a Collection (Group), Hip Traveller cannot recover any data associated to that Group.
-
Hip Traveller does not store any deleted information or data.

How to control the images you upload

All images uploaded to Travel, Dining and Events are only shared with your contacts and are private.
-
Images uploaded to ‘Community’ are shared with the wider Hip Traveller community and only people with the Hip Traveller app can see 'Community' Groups.

If you do not want to share any images or information with the wider Hip Traveller community then use your private Groups; Travel, Dining and Events only.

If you would like to delete any images then simply click the delete button on the images you upload.
-
Only people with an iPhone who have downloaded the Hip Traveller app can view Community groups.

How data is deleted
Once you delete your profile (account) then all personal information (data) associated with your profile is permanently removed. Your personal information including name, email, and phone number is deleted. Any private information is permanently deleted. Hip Traveller does not store deleted information and therefor cannot recover your personal information (data) you delete.

Copyright
Any information you upload to a Collection or 'Group' in Community can be seen by any User that downloads the Hip Traveller application.
​
If you don't have your own images to share with people (users) then Hip Traveller recommends using FREE images from Unsplash or Pexels.
​
If you would like to use images from Google when creating a 'Community' Group then you can click on 'Tools' in Google search and then select 'Creative Commons licenses' from the drop down menu 'Usage Rights'. These image are also FREE to use.

Terms of Use (Terms and Conditions)
Hip Traveller’s Terms and Conditions (which we call ‘Terms’) have been created so that our community can be best governed to provide a safe place for people.
​
Hip Traveller’s Terms form a legally binding contract between you and Hip Traveller Pty. Ltd. (“Hip Traveller”). So please read them carefully.
​
By using Hip Traveller’s services you are subject to these Terms (referred to as the “Services”) and you agree to the Terms.
​
If so, Hip Traveller grants you a non-assignable, non-exclusive, revocable, and non sub-licensable license to use the Services in accordance with these Terms and our policies. Of course, if you don’t agree with the Terms, then don’t use the Services.
​
In simple terms Hip Traveller allows you to use its Services without restrictions if you agree to the Terms.
​
These Terms apply if you live in the EU, Europe, UK, Australia, New Zealand, Canada, Qatar, Saudi Arabia or the United States or if your principal place of business is in the EU, Europe, UK, Australia, New Zealand, Canada, Qatar, Saudi Arabia or the United States.

Adult content

We do not allow any accounts that promote or link to adult or pornographic content.

All sexual or pornographic context are strictly prohibited.

Hip Traveller reserves the right to delete any sexual content uploaded to its platform, and will delete your account if you breach these Terms.

Never post, or send nude or sexual content to people under the age of 18 - even of yourself. This includes drawings or messages, even as a joke.

Illegal content

Do not use Hip Traveller’s Service for any illegal purposes - including drugs, contraband or weapons.
​
Impersonation

Don’t pretend to be someone else including your friends, celebrities, brands or other organisations.
​
Zero Tolerance
-
Hip Traveller has zero tolerance for all forms of bullying and terrorism.
​
News or 'media content'
-
Hip Traveller is a Travel application for people to join communities and easily plan events whether travelling, dining or creating special occasions with friends and family.

Hip Traveller reserves the right to delete any content that is purposed for news or 'media' in the traditional definition of providing expert opinion, analysis or reporting of world events.
​
Other 'content'

Hip Traveller does not allow the use of its service for health advice, financial advice, recipes or to promote individuals like celebrities.

Hip Traveller reserves the right to delete any content that is purposed for health advice, financial advice, or to promote individuals.
If you violate any of these guidelines, we reserve the right to remove all your personal information, content and terminate your account, or even notify law enforcement. If you violate Hip Traveller’s Terms and guidelines, Hip Traveller will block your profile, and you may not use Hip Traveller’s service again.

Terms of Use Continued

1. Who Can Use the Services
Our services are not directed to children under the age of 17, and you must confirm that you are 17 years or older when you create an account and use the Hip Traveller's services. If we have actual knowledge that you are under the age of 17, we will cease providing services to you and delete your account and your data.
Please read all such terms carefully.
By using Hip Traveller’s Services, you represent, warrant, and agree that:

you are not a person who is barred from using the Services under the laws of the Australia or any other applicable jurisdiction — including, for example, that you do not appear on the U.S. Treasury Department’s list of Specially Designated Nationals or face any other similar prohibition;

you are not a convicted sex offender; and
-
you will comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations.
If you are using the Services on behalf of a business or some other entity, you represent that you are authorised to bind that business or entity to these Terms and you agree to these Terms on behalf of that business or entity (and all references to “you” and “your” in these Terms will mean both you as the end user and that business or entity you represent).
In simple terms: Our Services are not directed to anyone under the age of 17 or the minimum age at which a person may use the Services in your state, province, or country if it is older than 17. If we become aware that you are under this age or that you break our Terms, we will delete your account and you cannot use Hip Traveller's Services again.

2. Rights You Grant Us
Our Services let you upload images, send and receive messages, and store your personal information. When you do that, you retain whatever ownership rights for images you had to begin with. But you grant us a license to use these images to share with your contacts and the wider Hip Traveller community in 'community' Groups for information purposes only.
​
For all images you submit to the Services (including Public Content), you grant Hip Traveller a worldwide, royalty-free, sub-licensable, and transferable license to host, store, cache, use, display, reproduce, modify, adapt, analyse, transmit, and distribute these images.
This license is for the purpose of operating, developing, providing, promoting, and improving the Services.
We call Public content and information ‘content’ you submit to public Services, like Groups (Communities, Travel, Dining and Events) “Public Content.” Because Public Content is inherently public, you grant Hip Traveller, and other users of the Services an unrestricted, worldwide, royalty-free, irrevocable, and perpetual right and license to promote, exhibit, broadcast, reproduce, distribute, publicly perform, and publicly display all or any portion of your Public Content in any form and in any and all media or distribution methods, now known or later developed, for commercial and non-commercial purposes. This license applies to your Public Content, as well as the title, details, images, and location in Public Content that you create, upload, or appear in.
This means, among other things, that you will not be entitled to any compensation if your content, photos, title, image, likeness, or content uploaded for informational purposes only, users of the Services, or our business partners.
You agree that all Public Content you create must be appropriate for people ages 17+.
While we’re not required to do so, we may access, review, screen, and delete your content at any time and for any reason if we think your content violates these Terms or any applicable laws. You alone, though, remain responsible for the content you create, upload, send, or share through the Services.

Simply: If you upload content that you own to the Services, you remain the owner but you allow us and others to use it to provide information for our Services. You also allow other users to view and, in some cases, use any content you make available to others on the Services. We have various rights to change and remove your content, but you always remain responsible for everything you create or share.

3. Privacy
Your privacy matters to us. You can learn how your information is handled when you use our Services by reading our European Union GDPR data policy at the top of this page.

4. Content Moderation
The content on our Services is produced by users, communities, and other third parties like small to medium sized businesses. Whether that content is posted publicly or privately, the content is the sole responsibility of the user or entity that created it.
Although Hip Traveller reserves the right to review, moderate, or remove all content that is created on its Services, we do not review all of it. So we cannot — and do not — guarantee that other users or the content they provide through the Services will comply with our Terms, Guidelines.
People can report content created by others or others’ accounts for violation of our Terms, and Guidelines by emailing at ‘hiptraveller@hotmail.com’.

5. Respecting Peoples' Rights
Hip Traveller respects the rights of others and so should you. You therefore may not use the Services, or enable anyone else to use the Services, in a manner that violates or infringes someone else’s rights of publicity, privacy, copyright, trademark, or other intellectual property rights.
Hip Traveller honours copyright laws, including the Digital Millennium Copyright Act and takes reasonable steps to remove from our Services any infringing material that we become aware of. If Hip Traveller becomes aware that a person has repeatedly infringed copyrights, we will take reasonable steps within our power to suspend or terminate the person’s account.
If you believe that anything on the Services infringes a copyright that you own or control, please report it by sending an email to ‘hiptraveller@hotmail.com’.

6. Your Account
To use Hip Traveller’s Services, you need to create an account. You agree to provide us with accurate, complete, and updated information for your account. You are responsible for any activity that occurs in your account. So it’s important that you keep your account secure. One way to help keep your account secure is to select a strong password. If you think that someone has gained access to your account, please reach out to us at ‘hiptraveller@hotmail.com’.

Simply: Keep your account details safe and secure, and only use an account if you are authorised to do so.

7. Data Charges and Mobile Phones
You are responsible for any mobile charges that you may incur for using our Services. This includes data charges and charges for messaging, such as SMS, MMS, or other messaging protocols or technologies (collectively, “Messages”). If you’re unsure what those charges may be, you should ask your service provider before using the Services.

8. Termination and Suspension
You can terminate these Terms at any time if you do not agree with any changes we make to these Terms, or for any other reason, by deleting your profile on the Hip Traveller app. You may delete your account by clicking the pencil (edit) icon next to your profile and name, clicking 'delete' in your account view and confirming you want to 'delete' your account on the Hip Traveller app.

9. Disclaimers
Hip Traveller will try to keep the Services up and running and free of annoyances. But we make no promises that we will succeed.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” AND TO THE EXTENT PERMITTED BY LAW WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. IN ADDITION, WHILE WE ATTEMPT TO PROVIDE A GOOD USER EXPERIENCE, WE DO NOT REPRESENT OR WARRANT THAT: (A) THE SERVICES WILL ALWAYS BE SECURE, ERROR-FREE, OR TIMELY, (B) THE SERVICES WILL ALWAYS FUNCTION WITHOUT DELAYS, DISRUPTIONS, OR IMPERFECTIONS, OR (C) THAT ANY CONTENT, USER CONTENT, OR INFORMATION YOU OBTAIN ON OR THROUGH THE SERVICES WILL BE TIMELY OR ACCURATE.

NEITHER WE NOR OUR AFFILIATES TAKE RESPONSIBILITY OR ASSUME LIABILITY FOR ANY CONTENT THAT YOU, ANOTHER USER, OR A THIRD PARTY CREATES, UPLOADS, POSTS, SENDS, RECEIVES, OR STORES ON OR THROUGH OUR SERVICES. YOU UNDERSTAND AND AGREE THAT YOU MAY BE EXPOSED TO CONTENT THAT MIGHT BE OFFENSIVE, ILLEGAL, MISLEADING, OR OTHERWISE INAPPROPRIATE, NONE OF WHICH WE OR OUR AFFILIATES WILL BE RESPONSIBLE FOR.
Simply: Hip Traveller will try to make the Services available to you, but we do not make any promises regarding quality and will not be liable for any content which is not ours.

10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR MANAGING MEMBERS, SHAREHOLDERS, EMPLOYEES, AFFILIATES, LICENSORS, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR MULTIPLE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES, (B) THE CONDUCT OR CONTENT OF OTHER USERS OR THIRD PARTIES ON OR THROUGH THE SERVICES, OR (C) UNAUTHORISED ACCESS, USE, OR ALTERATION OF YOUR CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE DATE OF THE ACTIVITY GIVING RISE TO THE CLAIM.
Simply: We limit our liability for anything you do, instances where you cannot access the Services, things others do, and any issues resulting from unauthorised use of our Services. Where we are liable to you and you have suffered some loss, we limit our liability to a set amount.

11. Exclusive Venue
To the extent that these Terms allow you or Hip Traveller to initiate litigation in a court, both you and Hip Traveller agree that all claims and disputes (whether contract, tort, or otherwise), including statutory claims and disputes, arising out of or relating to the Terms or the use of the Services will be litigated exclusively in Australia, the State of Victoria.

12. Final Terms
These Terms, including our guidelines, make up the entire agreement between you and Hip Traveller, and supersede any prior agreements. These Terms do not create or confer any third-party beneficiary rights. If we do not enforce a provision in these Terms, it will not be considered a waiver of our rights to enforce these Terms. We reserve the right to transfer our rights under these Terms and provide the Services using another entity, provided that entity upholds these Terms. You may not transfer any of your rights or obligations under these Terms without our consent. We reserve all rights not expressly granted to you. Where we have provided summary sections in these Terms, these summaries have been included for your convenience only and you should read these Terms in full to understand your legal rights and obligations.
